Welcome to Momap! By using our app, you agree to these terms and conditions. Please read them carefully.

1. Acceptance of Terms
By creating an account and using Momap you agree to these terms and our Privacy Policy. If you do not agree, you should not use the app.

2. User Account
• You must be at least 13 years old to use the app.
• You are responsible for providing accurate information.
• You are responsible for the security of your account and password.

3. Use of the App
Momap allows users to create moments, invite friends, and add content. You agree to:
• Not post illegal, harmful, or offensive content.
• Respect the privacy of others.
• Not distribute spam, viruses, or other harmful software.
• Promote a positive and social environment.
• Only share content that you have created and be mindful of the consequences of sharing it.
Inappropriate content can be reported. We aim to review reports within 24 hours. We reserve the right to remove content or block accounts that violate these terms.

4. Intellectual Property
• You retain rights to the content you post. By uploading content, you grant us a non-exclusive, royalty-free license to use it for the app’s functionality.
• You may not share content that infringes on copyrights or other proprietary rights of third parties.

5. Privacy and Data Protection
We respect your privacy. Our Privacy Policy explains how we collect, use, and protect your data. By using the app, you consent to our data processing.
User data is retained as long as necessary to provide our service effectively.

6. Memories and Content Management
• Memories are by default visible to all your friends and the friends of your friends.
• When adding content, you have the option to make it private, restricting visibility to invited users only.
• Users can delete their own content and account at any time.
• If you delete your account, memories will remain, but your added content will be removed, and you will no longer appear on the guest list.

7. Third-Party Services
Momap integrates with third-party services to enhance functionality. By using the app, you acknowledge and agree that we may share necessary data with these third parties in accordance with our Privacy Policy. The third-party services we use include:
• Google Firebase – for authentication, database management, and cloud storage.
• Branch IO – for deep linking and attribution tracking.
• Bunny Stream – for video streaming services.
• AWS (Amazon Web Services) – for hosting and cloud computing.
• Google Maps – for location-based features.
These third-party services have their own terms and privacy policies, and we encourage you to review them. We are not responsible for their policies or actions.

8. Termination of Service
We reserve the right to terminate or restrict access to the app at any time, without prior notice, if you violate these terms.

9. Liability and Indemnification
• We provide the app “as is” and do not guarantee its flawless operation.
• We are not responsible for damages resulting from the use of the app.
• You agree to indemnify us from claims arising from your use of the app or violation of these terms.

10. Changes to the Terms
We may update these terms at any time. If significant changes occur, we will notify you. Continued use of the app means you accept the updated terms.

11. Applicable Law and Disputes
These terms are governed by Dutch law. Disputes will initially be submitted to the competent court in the Netherlands. If required by local law, disputes may be brought before a competent court in the relevant jurisdiction. We reserve the right to adapt these terms to comply with the applicable laws and regulations in the countries where we operate.
